Terms of Service

These Terms of Service (the "Terms") are an agreement between you and [legal entity name, registration number, registered address] (the "Operator", "we", "us") covering your use of Aitemos, the service available at aitemos.com (the "Service").

By creating an account or generating an image, you agree to these Terms. If you do not agree with any part of them, please do not use the Service.

You upload a photo of your product. The Service uses AI image generation to turn it into listing images: a clean main photo, lifestyle scenes, infographic slides with your specs, and optional short videos.

The generated images are yours to use in your listings on Amazon, Etsy, eBay, Shopify, or anywhere else you sell.

We do not guarantee any particular artistic outcome. AI generation is probabilistic: the same input can produce different results, and some results will not be usable. That is why we let you preview and regenerate rather than promising a perfect first attempt.

You sign in through a third-party identity provider (Google, Telegram, or Yandex). We receive your email address, display name, and profile picture from that provider - we never see or store your password for it.

You are responsible for keeping access to that provider account secure and for everything done in the Service under your account.

You must be at least 16 years old, or the age of digital consent in your country if it is higher, to use the Service. The Service is intended for business use by sellers and is not directed at children.

The Service runs on prepaid credits. 4 credits equal 1 generated image, so a full listing gallery of 6 to 7 images costs 24 to 28 credits. Short videos and revisions are priced in credits as well, and the exact cost is always shown before you confirm a generation.

Credits are sold in one-time packs. There is no subscription and no automatic recurring charge. Prices are listed in US dollars on the pricing page and include no hidden fees: HD downloads and the zip archive of your finished images are already covered by the generation cost.

Payments are processed by our payment provider lava.top, which acts as the merchant of record for the transaction. We never receive or store your full card number. Your payment is also subject to lava.top's own terms and privacy notice.

Credits are deducted when a generation starts, not when you download the result. If a generation fails on our side for technical reasons, the credits reserved for it are returned to your balance automatically.

Credits have no cash value outside the Service, do not accrue interest, and cannot be transferred or sold to another person. Purchased credits do not expire while your account is open.

Taxes: prices may be shown excluding VAT, sales tax, or other local charges. Where such taxes apply, they are calculated and collected at checkout by the payment provider.

New accounts receive 4 free credits on signup - enough to generate one image and judge the quality before paying anything. No card is required.

The welcome bonus is granted once per person, not once per email address. We may apply technical measures (including cookies and device signals) to enforce that, and we may withhold free credits from accounts that appear to be duplicates.

We may change the size of the free allowance or limit it entirely for future signups. Credits you already hold are not affected by such a change.

You keep all rights to the product photos you upload. By uploading them, you grant us a limited licence to store them and to send them to our AI generation provider for the sole purpose of producing your images. We do not use your uploads to train our own models, and we do not sell them.

You confirm that you own or are licensed to use every photo you upload, and that uploading it does not infringe anyone's copyright, trademark, publicity, or privacy rights.

You own the images the Service generates for you, to the extent such ownership is possible under the law of your country, and you may use them commercially, including in paid advertising. Note that in some jurisdictions (the United States among them) purely AI-generated material may not be eligible for copyright protection - that is a limitation of the law, not of your licence from us.

The Service itself - the software, interface, design, prompts, and the Aitemos name and logo - remains ours. Nothing in these Terms gives you the right to use our branding without written permission.

You may not use the Service to create or upload content that is unlawful; that infringes someone else's intellectual property; that depicts a real, identifiable person without their permission; that is sexually explicit; or that is designed to deceive buyers about what a product actually is.

You may not attempt to bypass credit deductions, usage limits, watermarks, or payment; probe or attack our infrastructure; scrape the Service in bulk; or resell access to your account.

Generated images must still comply with the rules of the marketplace where you publish them. Amazon, Etsy, eBay, and Shopify each have their own image and claim policies, and enforcing them is your responsibility, not ours.

We may suspend or terminate an account that breaks these rules. Where the breach is not severe, we will normally warn you first.

We aim to keep the Service running but do not promise uninterrupted availability. Generation depends on third-party AI providers, and their outages will affect us.

We may add, change, or remove features. If we retire a feature that your unused credits were bought for, we will either provide an equivalent or refund the affected credits under the Refund Policy.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that generated images will increase your sales, conversion rate, or ranking, that they will be accepted by any marketplace, or that they will be free of visual artefacts.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost sales, lost data, or business interruption, arising from your use of the Service.

Our total liability to you for any claim is limited to the amount you paid us for credits in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.

You agree to cover our reasonable costs if a third party brings a claim against us because of content you uploaded, images you published, or your breach of these Terms.

You can delete your account at any time from your profile page. Deleting it ends your access to uploaded photos, generation history, and any unused credits associated with it.

Unused credits are refundable only under the conditions set out in the Refund Policy - deleting your account by yourself is not, on its own, a refund request.

We may close an account that has been inactive for more than 24 months after giving notice to the email on file.

We may update these Terms. The current version is always on this page with the date it took effect, and material changes will be announced by email or in the app before they apply.

If you keep using the Service after a change takes effect, you accept the new version. If you do not accept it, stop using the Service and request a refund of unused credits under the Refund Policy.

These Terms are governed by the law of the Operator's place of registration, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live.

Before starting formal proceedings, please write to us - most disputes are resolved faster by email than by lawyers.
